CLUB RULES 2025
RULE 1.
The Club shall be called ‘Nenagh Boat Club’.
RULE 2.
The Club colours shall be Blue and White.
RULE 3.
Membership:
The subscription shall be fixed at the AGM. The membership year shall be from the A.G.M. until the next A.G.M.
RULE 4.
Any member who has not paid his subscription in full by May 1st shall be disqualified from exercising or using the privileges of membership and may not use the Club facilities.
Any member paying his subscription after May 1st shall be required to pay a penalty as decided by the Committee. Due to conditions imposed by the Club’s insurers, only paid-up members may use the Club.
If membership is fully paid but the allocated outside berth is not being used, the member must contact the Committee detailing why there is no boat in the berth. Otherwise, if the boat is not in by 31 of May, they lose their berth. The Committee has the right to reallocate the berth to the next person on the list.
Where a member’s subscription in full remains unpaid on May 1st, membership shall be deemed to have lapsed, and the name of the member shall be removed from the Register of Members. Such member’s property shall be removed from the Club premises. In exceptional circumstances the Committee at its absolute discretion may decide to extend the period for payment.
Where a member who has an allocated berth has not paid their subscription in full by May 1st, their allocated berth shall be forfeited and reallocated to a member on the waiting list. In exceptional circumstances, the committee at its absolute discretion, may decide to extend the period of payment.
Any member who has not paid his subscription cannot leave his property in or on the Club premises longer than 3 months. If left longer than that period, the Club reserves the right to either dispose of or return that property to a member’s last known address. If the property is sold, the Club shall retain the proceeds of the sale of that property. If the property is returned to the last known address, the Club shall do this without any liability to damage to the same property.

RULE 5.
Reduction in Annual Subscription:
A member on retiring from work or business shall, within the year of reaching the age of 66, or at any time thereafter and having completed 20 years of membership of the Club, shall be entitled to notify the Committee of such fact and shall be accorded a reduction of one half of the subscription. This same facility shall be afforded to family members on either partner reaching the qualifying age.
A member on reaching the age of 70 and having accumulated 20 years of membership of the Club, shall be accorded a reduction of three quarters of the Subscription. This same facility shall be afforded to family members on either partner reaching the qualifying age.
RULE 6.
Any member wishing to resign his membership shall give notice of such intention to the Honorary Secretary at least one week before the opening of the Club, and any member not giving such notice shall be deemed to be a member and held liable for his subscription for the ensuing season.
RULE 7.
Any member may nominate a candidate for membership, the same to be seconded by another member. An application form, including the appropriate subscription, shall be sent to the Honorary Secretary, who shall place the same before the next meeting of the Committee for balloting, which may be secret. A candidate shall be elected by a majority of the Committee.
RULE 8.
The Annual General Meeting of the Club shall be held in March each year.
RULE 9.
A printed copy of the Balance Sheet shall be made available to each member at the A.G.M.
RULE 10.
The Club shall be managed by the Committee constituted as follows:
Five Trustees, President, Chairman, Vice-Chairman, Honorary Treasurer, Honorary Secretary, Technical Officer and six Ordinary Members.
The President, Chairman, Vice-Chairman, Honorary Treasurer, Honorary Secretary, Technical Officer and six other members of the Committee shall be elected at the A.G.M.
No member shall be elected in their absence to any office of the Club or membership of the Committee unless they have given a prior undertaking in writing to accept the position.
In the interests of continuity, the Committee shall seek to ensure that only one officer may resign at each A.G.M.
RULE 10.A
Trustees
The Club premises and such other property of the Club as the Committee shall determine, shall be vested under the legal control of the Trustees and such Trustees shall deal with the property of the Club as directed by the resolution of the Committee of which an entry in the Minute Book shall be conclusive evidence.
If the Trustees, when directed by a resolution of the Committee to perform a certain act, consider that the performance of such an act is one of such importance that they consider that the Club members should be consulted, then the Trustees may refuse to perform such act until the Club members have been consulted at a General Meeting and a resolution is passed at such Meeting authorising or refusing to authorise the Trustees to perform such an act as was originally directed by the Committee.
The Trustees shall be appointed by the Meeting at a General Meeting of the Club. The Trustees in whom all the property of the Club shall be vested shall be Ex Officio members of the Committee, and shall continue in office for five years, at the end of which time they shall be eligible for re-election. Each Trustee shall hold office until resignation or removal from the office by resolution of the Members at the General meeting of the Club.
RULE 11.
The Committee shall hold a minimum of six (6) ordinary meetings for the transaction of business during the season, their schedule is at the discretion of the committee. The Chairman and the Honorary Secretary shall be empowered to convene a special meeting of the Committee when any circumstance comes to their knowledge that may appear to them to render such special meeting necessary.
RULE 12.
Forty-eight hours’ notice of such meetings shall be given to each member of the Committee. Five members form a quorum.
RULE 13.
Any vacancy occurring in the Committee during the year may be filled by the Committee co-opting a member.
RULE 14.
The Committee may summon a special General Meeting on giving through the Honorary Secretary, seven days’ notice of same to each member stating therein the object for which such a meeting is called. A Special General Meeting may be called on a requisition signed by at least twenty percent of the membership.
RULE 15.
Boats:
Any member has the right to use only one Club Boat for himself, on any single occasion, if a boat is available.
RULE 16.
Under no circumstances shall a member take a Club Boat from the Club premises except for immediate use. A member shall not retain a Club Boat at his residence or elsewhere when not in use. When a member no longer requires a Club Boat, the boat shall be returned forthwith to the Club premises. All Club Boats must be berthed in the club at night.
RULE 17.
A.
No child under eighteen may take a Club Boat unless accompanied by an adult.
B.
No more than four adults may be in a Club Boat at any time.
C.
All Club Boats shall be signed for when leaving and returning to the Club premises.
D.
Lifejackets or buoyancy aids shall be worn by all occupants of Club Boats.
E.
All private boat owners not occupying a covered berth must remove their boats from the water at the end of the season.
F.
Any member who lets a non-member use his boat, excluding his family, must record same in the logbook in the front office. Members shall be responsible for any non-member using their boat.
RULE 18.
The Club shall not be responsible for any loss or damage to the property of any member stored on Club Premises.
RULE 19.
Classes of Membership
Family Membership – which shall include husband/partner, and children under twenty-one years of age. The question as to what constitutes membership of a family shall be left to the discretion of the Committee.
RULE 20.
Any member losing or damaging to the property of the Club shall, when requested by the Committee, replace or otherwise make good such property.
RULE 21.
If any member has a cause of complaint against another member, no argument or discussion shall be entered into with that member. Instead, such member with the cause of complaint shall report the matter in writing to the Honorary Secretary.
The Committee shall have power to suspend, until the following General Meeting, any member who fails to conform to the rules of the Club. Any member disturbing the harmony of the Club shall be subject to such censure as the Committee shall choose to impose, but such member shall have the privilege of appealing to the General Meeting convened at his request for the purpose of hearing his appeal.
RULE 22.
No alteration of the General Rules of the Club shall be made except at a General Meeting or a Special General Meeting. Notice shall be given in advance of the intention to propose such alteration. An alteration shall be made if adopted by at least two thirds of the members present.
RULE 23.
Should any circumstances arise not already provided for by the rules, the committee shall have a discretionary power to deal with same.
RULE 24.
Members changing address shall inform the Honorary Secretary in writing so that he may make the necessary correction to the Club records. The address last communicated to the Honorary Secretary shall be deemed to be member’s proper address.
RULE 25.
Berths:
A.
Berths shall only be used for a lake boat seventeen to twenty feet long.
B.
Boats occupying berths must be used regularly.
C.
Berth-holders must pay their subscription, berth fee and any other charge levied by the Committee.
D.
A member may join the waiting list for berths by filling out the appropriate form and paying any charge levied by the Committee.
E.
All berths and other club property used by the Members shall at all times remain the sole property of the Club as vested in the Trustees. Members must acknowledge that they have no right, title or interest in the berths or any area surrounding or adjoining same.
F.
No member shall have any right to sublet his berth or allow any person, relative or other member to use his berth.
G.
The Committee shall have the authority to allocate any free berths (under cover) to members who request a winter berth. These berths will be allocated for the period November to February and must be vacated by the first day of March, or earlier if requested. This does not affect the rights of any member in whose name the berth is allocated.
RULE 26.
Berth shall be allocated to members for life.
Berth may be transferred to a member’s family upon application to the Committee, providing that Rule 25 is fully complied with.
The Committee shall designate an area in the Club premises for storage of small sailing dinghies (up to 14ft long) and Canoes. Dinghies and Canoes must be stored on trailers or trolleys in their designated area when not in use and may be launched from the Club slipway.
RULE 27.
This edition of the General Rules supersedes all previous and shall become effective in March 2025.
